Welcome to DarijaPro ("we," "our," or "us"). By accessing or using our website at darijapro.com (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Age Requirement

You must be at least 18 years of age to use this Service. By using DarijaPro, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. We do not knowingly provide services to individuals under 18 years of age. If we discover that a user is under 18, we reserve the right to immediately terminate their account without notice.

2. Description of Service

DarijaPro is an educational platform designed to help users learn Moroccan Arabic (Darija) and prepare for travel to Morocco. Our services include:

  • Translation services between English and Darija (and potentially other languages)
  • Dictionary and vocabulary learning tools
  • Interactive language learning games
  • Chatbot assistant (Darija Buddy) for learning Darija and Morocco information
  • My Morocco map feature for language reference by region
  • Moroccan holiday information
  • Personal phrase management and custom phrase creation
  • Shopping list and budget tracking tools

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain and update your account information as needed
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Subscription and Payment Terms

4.1 Free and Paid Services: DarijaPro offers both free and premium (paid) features. Premium features require a paid subscription.

4.2 Payment Processing: All payments are processed through Stripe, a third-party payment processor. We do not store your credit card information, payment details, or any financial data on our servers. All payment information is handled directly by Stripe in accordance with their security standards and privacy policy.

4.3 No Refund Policy: All purchases are final. Due to the digital nature of our services, we do not offer refunds under any circumstances, except in the case of accidental duplicate charges within the same billing period. If you believe you were charged in error or accidentally made a duplicate purchase, please contact us at Support@DarijaPro.com within 7 days of the charge.

4.4 Subscription Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. No partial refunds will be provided for unused portions of a subscription.

5. User Content and Ownership

5.1 Your Content: You may create, save, and store content on DarijaPro, including custom phrases, notes, shopping lists, budget entries, and map markers ("User Content").

5.2 Ownership: By submitting User Content to DarijaPro, you grant us a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content. DarijaPro owns all User Content submitted to the platform.

5.3 User Responsibility: You are solely responsible for all User Content you create and store on your account. You agree not to submit content that is illegal, offensive, defamatory, or infringes on the rights of others.

6. Disclaimers and Limitations

6.1 Educational Purpose Only: DarijaPro is provided for educational and reference purposes only. Our services are designed to help users learn Darija and prepare for travel to Morocco.

6.2 Translation Accuracy: While we strive for accuracy, we do not guarantee the accuracy, completeness, or reliability of any translations, dictionary entries, or language content. Translations may contain errors, and language usage may vary by region. Do not rely solely on our translations for critical communications.

6.3 Holiday Information: Moroccan holiday dates and information provided are for reference only. We are not responsible for the accuracy of holiday information. Please verify important dates through official sources.

6.4 Budget and Financial Tools: Budget tracking, expense tracking, and currency conversion features are for personal reference only and do not constitute financial advice. We are not responsible for any financial decisions made based on these tools. Do not use these features for actual financial planning or accounting purposes.

6.5 Map and Location Features: City locations and regional information in My Morocco are approximate and for reference only. Do not enter sensitive personal information such as exact addresses, phone numbers, or financial details.

6.6 Data Privacy: All notes, phrases, and entries you create are private and visible only to you. We do not access, read, or share your personal content.

7. Prohibited Uses

You agree NOT to use DarijaPro to:

  • Violate any applicable local, state, national, or international law or regulation
  • Attempt to gain unauthorized access to our systems, servers, or databases
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Use automated systems, bots, or scripts to access the Service without our permission
  • Attempt to reverse engineer, decompile, or disassemble any portion of the Service
  • Copy, reproduce, or distribute our content without authorization
  • Harass, abuse, or harm other users
  • Upload viruses, malware, or other malicious code
  • Circumvent any security measures or access controls
  • Create multiple accounts to abuse free features or promotions
  • Use the Service for any illegal, fraudulent, or unauthorized purpose
  • Resell, sublicense, or commercially exploit the Service without our written consent

8. Intellectual Property

All content, features, and functionality of DarijaPro, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of DarijaPro and are protected by United States and international copyright, trademark, and other intellectual property laws.

9. Third-Party Services

DarijaPro uses third-party services to provide certain features:

  • Stripe: For secure payment processing
  • Translation APIs: For automated translation assistance
  • Weather Services: For Morocco weather information

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARIJAPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, profits, or business opportunities
  • Personal injury or property damage
  • Errors, mistakes, or inaccuracies in content
  • Unauthorized access to or alteration of your data
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or similar issues transmitted through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless DarijaPro, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.

12. Account Termination

12.1 Termination by You: You may close your account at any time by submitting an account deletion request through our designated form. Upon submission, your data will be retained for 30 days and then permanently deleted.

12.2 Termination by Us: We reserve the right to suspend or terminate your account immediately, without prior notice, for any reason, including but not limited to: violation of these Terms, fraudulent activity, abusive behavior, or upon request by law enforcement.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of the United States.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DarijaPro regarding your use of the Service and supersede all prior agreements and understandings.
